FanFliQ Terms and ConditionsBY USING OUR WEBSITE, APPLICATIONS, OR SERVICES, YOU AGREE TO THESE TERMS – PLEASE READ THEM CAREFULLY.

1. IntroductionThese Terms of Use govern your use of FanFliQ and your agreement with FliqMedia Tech Private Limited ("we", "our", "us").
FanFliQ is accessible at www.fanfliq.app and through our official applications and branded community apps.

Definitions:

• "FanFliQ" – Our platform, including the website, fan app, creator app, branded fan apps, and the AI-powered dashboard.

• "User" – Any registered or unregistered user of FanFliQ, including Creators, Fans, Agencies, or Brands.

• "Creator" – A user who creates, manages, or monetizes content or communities on FanFliQ.

• "Fan" – A user who subscribes to, purchases from, or engages with a Creator or Brand’s content or community.

• "Agency" – Any individual or organization managing one or more Creators or Brands using FanFliQ.

• "Brand" – A user or organization using FanFliQ to build and manage a customer or fan community.

• "Team Member" – A sub-user with assigned permissions under a Creator, Agency, or Brand account.

• "Content" – Any media, text, data, or materials uploaded or shared by Users.

• "Fan/Creator Transaction" – Any payment-based interaction between a Fan and a Creator or Brand.

• "Dashboard" – The AI-powered analytics and marketing automation tool available to Creators, Agencies, and Brands.

2. Updates to These Terms

We may update these Terms for legal, technical, or business reasons.
You will be notified in-app or via email for significant changes.
Continued use of FanFliQ after updates means you accept the new Terms.

3. Registration

To use FanFliQ, you must:

• Be at least 13 years old (or legally allowed by your country’s laws).

• Provide accurate personal or business information.

• Maintain account security and confidentiality.

4. Your Commitments

By using FanFliQ, you agree that:

• Your account has not been previously terminated for violations.

• You consent to our communications and data processing (see Privacy Policy).

• You are responsible for all activities under your account, including those of your Team Members.

5. Use of the AI Dashboard

Creators, Agencies, and Brands may use the AI dashboard to:

• Connect social accounts (Instagram, Spotify, YouTube, Reddit) via official APIs.

• View fan/customer insights, sentiment analysis, and ranking data.

• Receive AI-generated campaign suggestions and marketing plans.

• Send emails, push notifications, or messages (AI-assisted but manually approved).

  Important:

• AI tools do not take automatic actions without your approval.

• Data insights are predictions and may not be 100% accurate.

• You are responsible for complying with marketing laws (anti-spam, GDPR, etc.) before sending outreach.

6. Data Ownership & Usage

• Creators, Agencies, and Brands retain ownership of fan/customer data linked to their communities.

• FanFliQ stores, processes, and analyzes this data solely to provide services.

• We may anonymize and aggregate data for research, analytics, and platform improvement.

7. Referral & Gamification Features

FanFliQ offers Referral FliQ and leaderboard-based gamification.

• Participation is optional.

• Rewards are subject to change and availability.

• Fraudulent activity (fake accounts, bots, manipulation) will lead to disqualification and possible account termination.

8. Branded Fan Apps

Creators and Brands may operate their own fan communities through FanFliQ’s infrastructure.

• FanFliQ provides the technology; content and engagement rules are managed by the Creator/Brand.

• Time-based posts (FliQs), exclusive drops, and discount offers must comply with applicable laws and our content guidelines.

9. Platform Rights

We may suspend or terminate your account:

• For violating these Terms or applicable laws.

• For fraudulent or harmful activity.

• Without notice in severe cases; with 30-day notice otherwise.

  
  

  We also own anonymized platform usage data for internal development.

10. Content Responsibility

• You retain ownership of your content but grant us a license to display and distribute it within FanFliQ.

• You may not upload infringing, harmful, or illegal content.

• FanFliQ does not endorse user content and is not liable for disputes or third-party misuse.

11. Payments & Subscriptions

• Platform Subscriptions (e.g., AI Dashboard access) are billed directly to Users and auto-renew unless cancelled.

• Fan-to-Creator Transactions are separate and governed by our Standard Fan-Creator Agreement.

• All payments are processed via third-party providers; currency availability depends on location.

• Subscription fees for dashboard access are non-refundable unless required by law.

12. Prohibited Activities

You may not:

• Engage in piracy, hacking, reverse engineering, or scraping.

• Use bots or automated tools without our consent.

• Bypass payment systems or attempt to exploit the platform.

13. Third-Party Integrations

• You must comply with all third-party API terms (Instagram, Spotify, YouTube, Reddit).

• Data availability may change if third parties modify their API policies.

14. Limitation of Liability

We are not liable for:

• Indirect or consequential losses.

• Losses from reliance on AI-generated insights.

• Downtime, errors, or API limitations from third parties.

15. Dispute Resolution

All disputes will be settled by binding arbitration:

• Seat: Chandigarh, India

• Language: English

• Number of Arbitrators: 3 (per the Arbitration and Conciliation Act, 1996)

16. Account Deletion

• Fans may delete their account anytime.

• Creators, Agencies, and Brands must wait until ongoing subscription cycles end.

• Data deletion will follow our Privacy Policy.

17. General Terms

• These Terms override any prior agreements.

• Rights are non-transferable without written consent.

• We may assign our rights in case of merger, acquisition, or business transfer.
